General Delivery and Guarantee Conditions, MAX LEHNER & CO. AG
1. Our prices are net off ramp, unless otherwise agreed. They are
non-binding. All expenses for packing, shipping, customs, taxes, installation, instructions,
and other expenses shall be borne by the purchaser. The delivery contract follows the
acceptance of the order. The VAT is not included in the price and, if necessary, will be
charged separately.
2. Payments shall be made according to the
agreed terms, always in Swiss francs in Graenichen. Payment may not be withheld or reduced
due to defects in the goods delivered or counterclaims of the customer. In case of late
payments we calculate default interest from the due date.
3. Transportation: All shipments are at the expense and risk of the
purchaser, which means that they take, from the moment the goods depart our factory or
warehouse, the full risk of damage, loss, delay, etc. The transport insurance is the
responsibility of the buyer.
4. Delivery time: Our information
about delivery times applies for readiness for dispatch of the goods from the factory
Graenichen. For partial payments, the delivery period begins with the payment of the first
sum. The agreed delivery period shall be extended accordingly:
- In cases of force majeure and unforeseen events such as: late or defective material and
piece deliveries from our suppliers; strikes, lock, epidemics, military or warlike
events, etc.: also in case of unexpected material or energy shortages, faulty castings
or other delays not caused by us in the completion of major parts and generally in case
of malfunction, transportation obstacles, governmental prohibitions or impediments.
- Failure to comply with the agreed terms of payment.
- If all the information necessary to execute the order does not arrive on time into our
possession, or if subsequent changes are desired.
5. The warranty period is according to the agreed terms, calculated
from commissioning, for defective parts of the product delivered by us in material and
workmanship. For other products provided, we assume no responsibility, but this remains
solely with the customer. Any other compensation claims can not be accepted. Transport costs
and fitter charges shall in any case be borne by our customers. For further defects, in
particular for the consequences natural deterioration, excessive loading, incorrect
treatment or improper installation and maintenance of delivered spare parts, as well as
costs of business interruption or passenger and property damage, we are not responsible.
6.
Complaints regarding deliveries need to be made at the latest within 8
days of receipt of the goods in writing.
7. Retention of title:
until receipt of payment, the goods delivered shall remain our property.
